Mr. Wist represents employers in labor and employment matters, focusing on workplace safety and health and industrial crisis management. He is regularly called upon to defend clients in high-stakes litigation on a wide range of matters following workplace accidents and other emergencies. Over the course of his legal career, Mr. Wist has counseled clients following disasters in a wide variety of industries, including construction sites, surface and underground mines, cement plants, pipelines, electrical generation facilities, smelters, and chemical plants.
Mr. Wist handles regulatory matters for clients before federal and state agencies involved in safety and health enforcement, including the Occupational Safety and Health Administration (OSHA), the Mine Safety and Health Administration (MSHA), the Pipeline and Hazardous Material Safety Administration (PHMSA), and the Chemical Safety Board. In addition, Mr. Wist frequently advises and trains employers regarding inspection strategies, liability prevention, and crisis management. His litigation experience includes representation of employers on retaliation and whistleblower claims.
Mr. Wist has particular experience representing mine operators in a broad range of matters. With family roots in Colorado's coal mining industry, as well as mining work experience during his education, Mr. Wist has a deep understanding of the mining industry and how it is regulated by government agencies. Mr. Wist has litigated cases for mine operators and contractors in numerous western states, including Alaska, Arizona, California, Colorado, Idaho, Nevada, New Mexico, Utah, Washington, and Wyoming. He is also actively involved in several trade associations and educational organizations that advocate for the natural resources industry.
Mr. Wist serves in the Colorado General Assembly as State Representative for House District 37. He is a former member of the Colorado Lawyers Committee Executive Committee; the Dean's Advisory Board for Arts, Humanities and Social Sciences at the University of Denver; the Colorado Task Force on Civil Justice Reform; and the Board of Trustees for Colorado Mesa University. For many years, Mr. Wist has been a mock trial coach for Regis Jesuit High School, leading teams to success at the state and national levels.
