Brian L. Moffet has a diverse consumer financial services litigation
practice focused on mortgage-related litigation, including foreclosures
and mortgage servicing, lender-liability claims, arbitration, commercial
law, and class action defense.
Brian represents financial institutions from national banks to
mortgage lenders and other financial services providers in litigation
and arbitration involving claims and defenses arising under the Truth in
Lending Act (TILA), the Real Estate Settlement Procedure Act (RESPA),
the Fair Credit Reporting Act (FCRA), the Fair Debt Collection Practices
Act (FDCPA), the Equal Credit Opportunity Act (ECOA), the Credit Repair
Organizations Act (CROA) and state unfair and deceptive acts and trade
practices laws (UDAP). He has defended class actions in federal and
state courts throughout the United States. Brian also has enforced
arbitration agreements in both federal and state courts, and has
defended clients in a variety of matters that have gone to arbitration,
including a national class arbitration.
