Peter merged his practice with
and joined Capell Barnett Matalon & Schoenfeld LLP (CBMS) and joined as a
Senior Partner effective January 1, 2016. He now manages the firm's growing
litigation practice. He brought with him his team from Sanders Litigation
Associates, P.C. (SLA), a firm which he founded 15 years earlier in 2001.
Through the years the practice has grown in sophistication and breadth of
practice to include a wide variety of litigation matters before all trial level
courts. These include the Supreme, District and Civil Courts, Federal and
Surrogates Courts, and the governing Appellate Courts throughout Manhattan,
Brooklyn, Queens, Bronx, Nassau and Suffolk Counties. The litigation
practice also handles select matters before Administrative Agencies such as the
New York City Human Rights Commission, the DHCR and HPD. The Litigation
Department collaborates closely with the firm’s Real Estate Development,
Construction, Zoning, Commercial Leasing, Transactional, Religious Corporation,
Tax, White Collar Criminal, Corporate and Estate Administration practices.
Further solidifying our standing as one of the preeminent firms
handling religious corporation matters, our team has recently chalked up some
big wins in the trial and appellate courts (including the Appellate Division
1st Dept., NYS Court of Appeals and U.S. Supreme Court) involving First
Amendment constitutional issues over the justiciability of intra-denominational
religious doctrine and ecclesiastical sovereignty. Some of these cases were
reported in the New York Law Journal, including one with a front-page cover story.
Our newest litigation associate, who joined us from an internationally renowned
firm of nearly a thousand attorney worldwide, successfully argued a federal
appellate death penalty case which sent the case back to the state court in Tennessee.
After picking a jury, the District Attorney offered a very favorable plea deal
that avoided capital punishment.
Peter prides himself in having established a team with a
reputation as fierce advocates for their clients, who know how to leverage
their litigation skills to achieve a successful resolution whether it be
through trial or a pragmatic settlement. In his 26 years of practice he has
personally tried over a hundred cases, ranging from bench trials lasting from
one day to up to twenty-three days over seven weeks, and a week-long jury
trial. The vast majority have resulted in very favorable verdicts for our
clients. He has also successfully negotiated advantageous settlements in well
over a thousand cases and prevailed in over a dozen appeals. He has been
invited to lecture on various litigation topics to judges and attorneys alike,
at bar associations, continuing education forums, and judicial seminars sponsored
by the New York City courts. Peter is a past four-term Vice President of the
Kings County Housing Court Bar Association and continues to serve on its
Appellate and By-Laws Committees. He also works with a wide variety of
religious and not-for-profit corporations on real estate, leasing, and
litigation matters.
