Justin Ristau is a partner and chair of Bricker & Eckler's Creditors' Rights & Bankruptcy group and a member of the firm's Shale Task Force. His practice includes both creditor's rights litigation and oil and gas litigation.
He represents financial institutions in matters involving the full range of complex federal, state and common law issues that arise in the context of consumer financing, residential and commercial mortgage lending. In addition to defending complex contested foreclosure actions, Justin defends residential mortgage lenders and servicers against affirmative claims brought in state court, bankruptcy court, district court and on appeal. Justin also represents clients in cases involving bankruptcy, bankruptcy litigation, commercial foreclosure, workout and reorganization, usually representing secured and unsecured creditors in bankruptcy cases, adversary proceedings, and bankruptcy appellate proceedings, as well as in pre-litigation workout and state court commercial foreclosure and receivership proceedings. He also participates in various adversary proceedings in bankruptcy court, including preference and fraudulent transfer proceedings, nondischargeability proceedings and proceedings to determine the validity and priority of various claims or interests.
In addition, Justin represents public and private landowners in disputes involving oil and gas leases, mineral rights ownership and other issues related to shale development.
