Important Litigation Involvement

  • On October 27, 2010, Forman Watkins Krutz & Tardy was presented with the U.S. Chamber of Commerce Institute for Legal Reform's 2010 Award for Outstanding Organization. In selecting Forman Watkins for the honor, the Chamber recognized Forman Watkins's ongoing work to expose screening fraud in mass tort cases nationwide.  These efforts include work that produced the historic decision by Judge Janis Jack in 2005 dismissing more than 20,000 silica claims based on fraudulent actions by plaintiffs and their attorneys, in which Mr. Mulholland served as a member of the Defendants' Steering Committee; and a jury verdict this year in federal court (Illinois Central Railroad vs. Willie R. Harried, Warren Turner, Jr., William S. Guy, and Thomas Brock) finding asbestos plaintiffs' attorneys William Guy and Thomas Brock committed fraud in the filing of asbestos lawsuits, in which Mr. Mulholland served as lead trial counsel; as reported in national media, including The National Law Journal and Corporate Counsel.
  • Served as a member of the Defendants' Steering Committee in the Silica MDL in Corpus Christi, Texas, which resulted in a historic order and opinion by Judge Janis Jack (In Re Silica Products Liab. Litig., 398 F.Supp.2d 563), as reported in numerous national media, including the New York Times, Fortune Magazine, NPR, The Wall Street Journal, Houston Chronicle and Reader's Digest.
  • Lead trial lawyer representing Illinois Central Railroad in Illinois Central Railroad Company vs. Willie R. Harried, Warren R. Turner, William S. Guy and Thomas W. Brock; Civil Action No.5:06-CV-160 DCB-JMR.  A federal jury in Natchez, Mississippi, on March 8, 2010, found that Mississippi plaintiffs' attorneys William Guy and Thomas Brock committed fraud and breached the duty of good faith and fair dealing in asbestos claims they filed against Illinois Central Railroad.  The jury found that Guy & Brock of McComb, Mississippi, submitted fraudulent information to Illinois Central Railroad to conceal their clients' involvement in the earlier case (David Cosey v. E.D. Bullard Co., 1995), which would have barred their clients' claims against Illinois Central.  The jury awarded Illinois Central full repayment of the $210,000 Illinois Central paid on those claims plus an additional $210,000 in punitive damages.
