Lee Stuart Smith is a Partner in the firm's Real Estate
Section. Mr. Smith represents state and national financial institutions in
connection with their Florida and multi-state commercial and real estate lending
activities and workouts of distressed loans. Mr. Smith has significant
experience representing lenders in loan workouts including loan modifications
and restructurings, deeds in lieu of foreclosure, forbearance agreements,
foreclosures and sales of REO. His lending representation has included
financings for hotels and timeshare resorts, retirement and assisted living
facilities, shopping centers, office buildings, industrial centers, apartment
communities and residential subdivision development including borrowing base and
asset based loans and loan participations and syndications.
Mr. Smith
also represents developers of master plan, residential and multifamily projects
which includes the representation of national and international commercial and
residential developers in numerous areas of real estate and land use law,
including land acquisition, ground leases, construction contract negotiations,
builder agreements, financings including derivative swap agreements, site plan
negotiations and approvals, developers agreements, easements, variances,
conditional uses, leasing, impact fee agreements and community development
districts, including the first community development district ever approved by
the City of Orlando.
