Andrew G. Fusco is a partner in the Morgantown, West Virginia, office of Bowles Rice. He focuses his practice on general and complex litigation, antitrust, competition law, RICO, business disputes, white-collar criminal defense, intellectual property infringement, mergers and acquisitions, product and technology licensing, pharmaceutical law and first amendment law.
Mr. Fusco received his bachelor's degree from West Virginia University and earned his law degree from the West Virginia University College of Law.
He has maintained a close connection with his alma mater, having instructed at West Virginia University’s School of Journalism (1997 - 2003), College of Business and Economics (1975 - 76) and College of Law (1975 - 1976). In addition, he has lectured at the West Virginia University School of Pharmacy.
Mr. Fusco served as the prosecuting attorney of Monongalia County from 1977 to 1981. Mr. Fusco was the lead counsel for Plaintiff in Mylan v. AKZO, et al., Civil Action No. R90-1096 (DC, MD), a massive RICO case that arose out of the so-called “generic scandal” of the late 1980s.
He is the author of “Antitrust Law” in the West Virginia Practice Handbook (Michie: 1991), along with other articles in various books and journals. He has spoken on intellectual property and other legal matters to groups, including the Food and Drug Law Institute.
Mr. Fusco has been named a West Virginia Super Lawyer (2007, 2011-2013) and recognized by Best Lawyers in America (2010-2014) for antitrust litigation, commercial litigation, corporate governance law, intellectual property litigation and mergers and acquisitions law.
He has represented clients in transactions, litigation or administrative proceedings in 21 states and the District of Columbia, and in 13 countries outside of the United States. He is admitted to practice in West Virginia, as well as before the United States Courts of Appeals for the Fourth, Ninth and Federal Circuits, the United States Supreme Court, United States Tax Court and the United States District Court for the Northern and Southern Districts of West Virginia and has appeared in behalf of clients before the U.S. Federal Trade Commission and the U.S. International Trade Commission.
Mr. Fusco is a member of the American Bar Association (ABA Antitrust Law Section, Business Torts and Civil RICO Committee), West Virginia State Bar, and the Monongalia County Bar Association.
